Things to Remember.
Please find our terms and conditions below. We reserve the right to change these at any time without prior notice.
1) To book a session the booking can be done by email or Phone.
2) A date will be specified which suites both Keepsake Photography NI and the Client.
3) Booking form has to be filled within 48 hrs. Failure to do so will result in loss of the booked time and date to other clients.
4) If the Client cancels or reschedules the appointment over 72 hours before the session date, a fee of £7 is applicable and the booking process has to be done from start again if needed.
5) At the session it’s only permitted for Parents / Legal Guardians to attendants along with the child whose photo session is for; this is to avoid distraction for the photographer and the child / children.
6) No personal camera is allowed at the session.
7) The payment of the agreed package has to be paid in full at the session.
8) After the completion of the session the photos can take up to 6 weeks (Monday to Friday and do not include public holidays and weekends) to process, after processing the disc takes 1 working day (Monday to Friday and do not include public holidays and weekends) for packaging and dispatch via Royal Mail to the address provided by the client. If client have requested, a sneak peek of 1 photo chosen by the photographer will be uploaded on Keepsake Photography NI Facebook fan page as soon as possible.
In case of any delays Keepsake Photography NI will contact the client A.S.A.P.
The above mentioned term number 8) is not applicable to all winning and prop sessions.
9) All Vouchers is valid only for 6 months from the date of the voucher. No show or cancellation of the agreed date of the session will result in cancellation of the voucher. Booking a date has to be done 7 days in advance. Vouchers are non-transferable, non-negotiable, non-refundable, non-extendable & non- exchangeable.
10) Keepsake Photography NI reserves the right to cancel the session at any time if any of the terms and conditions are breached by the client.
11) All forms and agreements can be filled on-line or at the session and has to be signed by the parent or the guardian at the session if requested by Keepsake Photography NI’s photographer.
12) Keepsake Photography NI reserves the right to host/post/display all the photographs taken at any session, for the purpose of displaying/advertising on our website, gallery, Facebook, etc… If you wish your photographs not to be used by Keepsake Photography NI please inform Keepsake Photography NI before booking a session.
13) All offers have to be booked and shoot during the offer time period. Any booking or shoots after the offer time period will be charged at the regular prices.
14) Watch me grow package must be shoot on time as per the mentioned time on the offer and client is responsible to contact Keepsake Photography NI 7 working days prior each shoot.
Newborn session has to be shoot with in 14 days of birth.
6 months shoot should be shoot when the child is 6 months only and can only be extended until the child is 7 months old after that this session is automatically forfeited.
1 year shoot should be shoot when the child is 1 year only and can only be extended until until the child is 1 year & 1 month old after that this session is automatically forfeited.
Bonus outdoor family session can be shoot at any time prior the child reaches 1 year and 2 months old after that this session is automatically forfeited.
Keepsake Photography NI is not liable or responsible if the client fails to book their shoot on time allotted and offers no refund.
15) Please ensure you arrive for your photo session appointment on time. In-case of late arrival Keepsake Photography NI reserves the right to reschedule your photo sessions appointment.
16) In case of disc lost in post or not arrived, Keepsake Photography NI is not liable or responsible for Post Office services. Keepsake Photography NI is only liable to re-post the disc after reconfirmation of the postal address. Re-post service is only available until 30 days of session date. All follow ups, inquiries or complaints have to be direct to Post Office.
A single session fee of £25 is applicable to all packages which is included in the package fee. In case of no show / cancellation, the session fee is required to be paid.
By booking a session or using any of our products and services you hereby agree to all the terms and conditions of Keepsake Photography NI.

TERMS AND CONDITIONS
For the purpose of this agreement ‘”the Client” shall where the context so admits include their respective assignees, sub-licensees and successors in title. In cases where the Photographer’s client is a direct client (i.e. with no intermediary, all references in this agreement to “the Client” shall be interpreted as references to the Photographer’s client. “Photographs” means all photographic material furnished by the Photographer, whether transparencies, negatives, prints or any other type of physical or electronic material.
The entire copyright in the Photographs is retained by the Photographer at all times throughout the world. No modification / alteration what so ever is allowed / permitted on any of the photographs unless done by Keepsake Photography NI any violation will result in legal action against all parties involved.
3. OWNERSHIP OF MATERIALS
The client is licenced to use the photographs in accordance to the licence / permission given by the photographer, which states by default that all photographs can only be used for personal use of the client only. No modification / alteration what so ever is allowed / permitted on any of the photographs unless done by Keepsake Photography NI any violation will result in legal action.
The Licence to Use comes into effect from the date of payment of all sums due by the Client to the Photographer for use of the Licence. No use may be made of the Photographs before payment in full of all sums due without the Photographer’s express permission. Any permission which may be given for prior use will automatically be revoked if full payment is not made by the due date or if the Client is put into receivership or liquidation. The Licence only applies to the Client and product as stated on the front of the form and its benefit shall not be assigned to any third party without the Photographer’s permission. Accordingly, even where any form of ‘all media’ Licence is granted, the photographer’s permission must be obtained before any use of the Photographs for other purposes e.g. use in relation to another product or sublicensing through a photo library. Permission to use the Photographs for purposes not agreed must be sought and will normally be granted upon payment of a further fee, which must be mutually agreed (and paid in full) before such further use. Unless otherwise agreed in writing, all further Licences in respect of the Photographs will be subject to these terms and conditions. No modification / alteration what so ever is allowed / permitted on any of the photographs unless done by Keepsake Photography NI. Any violation of this term will result in legal action.
The Client will be authorised to publish the Photographs to the exclusion of all other persons including the Photographer. However, the Photographer retains the right in all cases to use the Photographs in any manner at any time and in any part of the world for the purposes of advertising or otherwise promoting his/her work. After the exclusivity period indicated in the Licence to Use the Photographer shall be entitled to use the Photographs for any purposes.
6. CLIENT CONFIDENTIALITY
The photographer will keep confidential and will not disclose to any third parties or make use of material or information communicated to him/her in confidence for the purposes of the photography, save as may be reasonably necessary to enable the Photographer to carry out his/her obligations in relation to the commission.
The Photographer agrees to indemnify the Client against all expenses, damages, claims and legal costs arising out of any failure by the Photographer to obtain any clearances for which he/she was responsible in respect of third party copyright works, trademarks, designs or other intellectual property. The Photographer shall only be responsible for obtaining such clearances if this has been expressly agreed before the shoot. In all other cases the Client shall be responsible for obtaining such clearances and will indemnify the Photographer against all expenses, damages, claims and legal costs arising out of any failure to obtain such clearances.
Full payment is to be paid at the time of the session or full payment in advance by purchasing vouchers via PayPal online. All payments received are non-refundable.
We only accept payments in Cash or via PayPal we do not accept any other forms of payments i.e. Checks or Post Order.
Where extra expenses or time are incurred by the Photographer as a result of alterations to the original brief by the Client, or otherwise at their request, the Client shall give approval to and be liable to pay such extra expenses or fees at the Photographer’s normal rate to the Photographer in addition to the expenses shown overleaf as having been agreed or estimated. If any of the props or equipment is damaged by any of the attendees or clients family members. The client is liable to pay damage charges equivalent to the current market value of a new item that is damaged.
The Client may not reject a photograph on the basis of style or composition unless agreed and pays a fee acceptable to the Photographer.
11. RE-SHOOT POLICY
In the instance where you are unhappy with the images from your shoot, we have a re-shoot policy. The re-shoot policy states that we will, at our discretion, invite the client back for a re-shoot. We will only offer a re-shoot where we believe it is necessary. If the client simply wants more images or is unrealistic about how his/her child should appear or if it is based on the likeness of the client we will not offer a re-shoot. All extra images after dispatch of the disc will be deleted immediately. All the images on disc is checked and verified to be of the highest quality in accordance with the accepted practices of all professional photographers and photographic laboratories.
12. CANCELLATION & POSTPONEMENT
A booking is considered firm as from the date of confirmation (booking form) and accordingly the Photographer will charge a fee of £7 for rescheduling or postponement which is done 72 hours prior of the session time.
In case of no show / cancellation a £25 session fee is required to be paid.
13. RIGHT TO A CREDIT
If the box on the estimate and the licence marked “Right to a Credit” has been ticked the Photographer’s name will be printed on or in reasonable proximity to all published reproductions of the Photograph(s)
14. ELECTRONIC STORAGE
All final images will be stored for a period of 30 days from the date of disc dispatch / postage, after which they will be deleted unless the client purchases our storage service which is for a duration of 1 year and is renewable. Manipulation of the image or use of only a portion of the image may only take place with the permission of the Photographer. Any violation will result in legal action.
Keepsake Photography NI has NO REFUND POLICY under any circumstances.
16. APPLICABLE LAW
This agreement shall be governed and construed in accordance with the laws of Northern Ireland. Both parties submit to the non-exclusive jurisdiction of the courts of Northern Ireland.
These Terms and Conditions shall not be varied except by agreement in writing.
